41. The owner of private land on which a habitat of a threatened or vulnerable plant species demarcated on a chart prepared by the Minister of Sustainable Development, Environment and Parks is situated cannot be convicted of an offence under section 17 or for violation of a standard or condition of management prescribed by regulation committed in that habitat unless he had prior notification of the existence of the habitat.
The Minister of Sustainable Development, Environment and Parks may request the registration, in the land register, of a reference to the existence of a habitat of a threatened or vulnerable plant species on the land. The request of the Minister is made by means of a notice filed at the Land Registry Office; such notice shall be in lieu of a notice of the existence of a habitat of a threatened or vulnerable plant species on that land in respect of any person who becomes the owner thereof after the registration.
